What are the impacts of the recent Rescission of DACA to DACA Recipients and Those Who Qualify for DACA?

We are receiving a flood of calls regarding the recent rescission of DACA benefits and what the impacts are to DACA beneficiaries.  Below is a summary of how the rescission impacts them and what actions, if any, they can take to extend their benefits.

Important Information & Actions

  1. If you are currently a DACA beneficiary, you will retain both your deferred action and employment authorization through the expiration dates.
  2. If USCIS received your initial or renewal DACA request and associated application for an employment authorization document (EAD) on or before September 5, 2017, USCIS will continue to adjudicate your request.
  3. If your DACA benefits will expire between September 5, 2017, and March 5, 2017, and you want to renew your benefits, you must file your renewal request on or before October 5, 2017.
  4. If you did not request initial DACA benefit on or before September 5, 2017, the DACA process is no longer available to you.
  5. If your DACA expired and you did not file your renewal request on or before September 5, 2017, the DACA process is no longer available to you.
  6. If you have DACA and your valid employment authorization document (EAD) is lost, stolen, or destroyed, you can still request a new one by submitting an I-765 for a replacement EAD.
