Initial DACA Applications Already Being Approved

USCIS has already approved new DACA cases weeks after a US District Court ordered USCIS to resume receiving initial applications on December 4, 2020. According to US News and World Report, 171 new applications for DACA were approved by the end of 2020. USCIS reports already receiving 2,713 applications for initial DACA applications.

Do You Qualify to file an Initial DACA Application?

In order to be eligible for DACA, you must meet certain requirements. Review the eligibility requirements below to determine if you may be able file an application.

You may qualify for DACA if you:

  1. Were under 31 on June 15, 2012;
  2. Came to the US prior to your 16th birthday;
  3. Have continuously lived in the US since June 15, 2007 through today;
  4. Were in the US on June 15, 2012, and at the time of making your request for DACA;
  5. Did no have lawful immigration status on June 15, 2012;
  6. Are in school, graduated from high school, have obtained a GED, or were honorably discharged from the US Coast Guard or Armed Forces;
  7. Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not pose a threat to public safety or national security.
